These Terms apply to ItsMyWill.com (“this Service”), published by itsmylife LLC (“the Publisher”). Use of this Service is subject to these Terms & Conditions.

This Service enables people to use electronic communication to obtain a Last Will Pack, including the Last Will, Living Will and two Powers of Attorney. All notices that we provide to you electronically satisfy any legal requirement for communications to be in writing.

To create documents for the Last Will Pack, the Publisher uses information that you provide. This information is used only by the Publisher, and only for the fulfillment of services provided by the Publisher (as a Publisher or as an affiliate) and the notification of any new services provided by the Publisher. It is the Publisher’s committed policy that, in respect of services provided directly by the Publisher, it never shares, sells or provides in any way any personal information you supply about you or any other person. There is just one exception, and this applies only if the Publisher is required by law to comply with a subpoena, search warrant, court order or other legally valid reason compelling us to release this information.

By making payment, you authorize and retain the services of the Publisher to produce for you a Last Will Pack based on your answers to the Questionnaire supplied by the Publisher in the Setup Portfolio. You accept full responsibility both for the completeness and accuracy of information that you provide to the Publisher and for the final decision on approval of your documents. You understand that the Publisher is not a law firm and cannot represent you in Court and the Publisher does not provide legal advice, only legal information. You understand and agree that fees to the Publisher are for computer time, inputting of information, preparation of documents and any changes to documents that you may request. You accept that these fees do not cover any legal fees, court costs, filing fees or costs related to legal actions. You also understand and agree that changes to your documents will be charged according to the Fee Schedule at that time, published at www.ItsMyWill.com. Payment gives you non-exclusive license to use this Service and provides the right to submit a completed Questionnaire and to receive all of the prepared legal documents in your Last Will Pack. Payment is by credit card, through the payment collection system being used for the Publisher at that time. By paying, you agree that your purchase will be bound by these Terms & Conditions, which constitute the complete contract between you and the Publisher.

This Service is suitable for you to use if:

• You can read and write in English.
• You understand why you need a Last Will and what having a Last Will achieves.
• You live in any US state except Louisiana.
• You want simple legal documents that express your wishes clearly.

Don’t use this service to obtain a Last Will Pack if:

• You live in Louisiana.
• Your possessions and assets are worth more than $1,000,000.
• You're providing for the long-term care of a disabled person.
• You want a complex Estate Plan to minimize taxes.
• You want detailed legal advice.

The right to use this Service cannot be transferred to or shared with any other individuals or entities. Couples each get their own Last Will, Living Will and Powers of Attorney for Health and Finance.

The Publisher constantly monitors this Service for viruses, Trojan Horses and worms to keep the Service and documents downloaded by the user free of these destructive predators.

The Publisher shall have no liability or shall not be deemed to be in default for any delays or failures in performance under these terms & Conditions resulting from acts beyond its control, including but not limited to acts of God, acts or regulations of any governmental or supranational authority, war or national emergency, terrorist activities, flood, rainfall, wind, fire or accident. The Publisher accepts no responsibility for any loss, injury, claim, liability or damage of any kind resulting from, arising out of or in any way related to:
(a) Any errors in or omissions from this Service, software or downloads.
(b) The unavailability of any part of this Service, software or downloads.
(c) Your use of any third party websites accessed through links in this Service.
(d) Your use of this Service, software or downloads. If you or your heirs or if any beneficiary or appointee named in your Last Will & Testament suffer a loss from your failure to follow the Last Will Pack Vital Instructions exactly, the Publisher will be indemnified by you or your estate against any claim that person may make, including attorney fees and Court costs.
(e) Your use of any equipment or software in connection with this Service, software or downloads.
(f) Any errors or omissions entered or not entered by you.

Parties covered by these Terms & Conditions extend beyond the Publisher to its affiliates and any officer, director, employee, subcontractor, agent, successor, or assign of the Publisher and its affiliates.

These Terms & Conditions may be updated from time to time, but will not be considered to be amended or altered by any written or oral statement to, or action by, the Publisher in response to a specific customer.

As the Publisher is a Florida corporation, these Terms & Conditions are subject to the law of the state of Florida. Any disputes with the Publisher will be dealt with by the Courts of the state of Florida.
